White Glove Appliance Service — Miami, Florida

These Terms and Conditions of Use (“T&C”) govern all appliance repair services (“Services”) and any products or parts (“Products”) provided to you (“Customer,” “you”) by White Glove Appliance Service (“White Glove,” “we,” “us,” “our”).

By scheduling, booking, or receiving Services, or by purchasing Products from us, you acknowledge that you have read, understood, and agree to be bound by these T&C.

This U.S. version is adapted from the Canadian Terms of Service you provided, including sections such as: “These Terms and Conditions of Use (this ‘T&C’) govern all services provided to you… by Elite Appliance Service…” and “Elite Appliance will take the following steps to complete the repair of your appliance(s): i. Conduct a diagnostic…”

1. Work Process

White Glove Appliance Service follows a structured process to diagnose and repair your appliance:

i. Diagnostic

A technician (“White Glove Technician”) will perform a diagnostic to identify the malfunction. Diagnostic fees and any applicable surcharges are non refundable, consistent with the original policy: “any and all fees charged… for the diagnostic process shall be non-refundable.”

You will receive a diagnostic report and receipt via email. If email is unavailable, a physical copy may be mailed to your service address.

ii. Quote (eQuote)

After diagnosis, you will receive a written estimate (“eQuote”) outlining repair costs and required parts. Quotes apply only to the malfunction identified during the diagnostic. If additional issues are discovered later, a revised or new eQuote will be issued.

iii. Quote Validity

If you decline the eQuote, no repairs will proceed. The eQuote remains valid for 30 calendar days, mirroring the original terms: “the eQuote is valid for 30 calendar days from the date it was issued…”. Approvals after 30 days require a new diagnostic and associated fees.

iv. Repair Completion

Upon completion of repairs, you will receive an electronic receipt (“eReceipt”) detailing fees, credits, and parts used.

2. Customer Responsibilities

a. Appliance Safety

Operating a malfunctioning appliance is unsafe and may cause further damage or personal injury. As stated in the original document: “Should you choose to operate your malfunctioning appliance, you will be assuming all risks…” White Glove is not liable for damages resulting from continued use of a malfunctioning appliance.

b. Parts Prepayment

If required parts are not in technician inventory, they must be prepaid before ordering. Delivery timelines depend on manufacturer availability and may range from several days to several weeks. Special order parts are non returnable and non refundable.

c. Installed Parts

Installed parts cannot be returned or refunded. Defective parts within the manufacturer’s warranty period will be replaced at no cost, consistent with the original policy: “parts… installed… cannot be returned, removed or refunded.”

d. Additional Malfunctions

If additional issues arise during testing, a new eQuote will be issued. Approval and prepayment are required before continuing repairs.

e. Failure to Follow Instructions

White Glove is not liable for losses resulting from failure to follow technician instructions or required steps.

3. Warranty

a. Labor Warranty

White Glove provides a 30 day labor warranty on all customer paid (“COD”) repairs. This warranty covers workmanship only, not the entire appliance. If the appliance malfunctions within 30 days due to workmanship or defective parts installed by White Glove, labor fees will be waived.

b. Parts Warranty

Parts warranty is governed by the original manufacturer’s warranty terms.

c. Warranty Void Conditions

Warranty is void if:

  • Parts installed were not purchased through White Glove
  • The appliance is serviced by anyone other than a White Glove Technician during the warranty period
  • The customer approves only partial repairs from an eQuote (mirroring original clause): “should a Customer decide to approve only a select few Products… the Warranty… shall be null and void.”

d. Warranty Exclusions

Warranty does not cover:

  • Customer misuse or neglect
  • Acts of God, pests, vermin
  • Issues caused by improper installation
  • Household wiring, plumbing, venting, or related issues

4. Indemnification

You agree to indemnify and hold harmless White Glove Appliance Service, its employees, contractors, and representatives from any claims, damages, or liabilities arising from your negligence, misuse, or breach of these T&C. This mirrors the original indemnification clause: “The Customer hereby agrees to indemnify and hold harmless Elite Appliance…”

5. Limitation of Liability

To the fullest extent permitted by Florida law:

  • White Glove is not liable for indirect, incidental, consequential, or punitive damages, including loss of use, time, profits, or business opportunities.
  • Maximum liability is limited to the amount paid for the specific Service or Product giving rise to the claim.
  • No claim may be brought more than one (1) year after the cause of action accrues.

This reflects the original limitation language: “IN NO EVENT SHALL ELITE APPLIANCE BE LIABLE… FOR ANY STATUTORY, SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES…”

6. Privacy

Your use of White Glove’s website and services is governed by our U.S. Privacy Policy. By using our services, you agree to the terms of that policy.

7. Website Use

You agree not to:

  • Interfere with website security or functionality
  • Upload harmful files or viruses
  • Attempt unauthorized access
  • Disrupt other users’ experience

8. General Provisions

a. Governing Law

These T&C are governed by the laws of the State of Florida and applicable U.S. federal laws.

b. Severability

If any provision is deemed invalid, the remaining provisions remain in full force.

c. Non Waiver

Failure to enforce any provision does not constitute a waiver.

d. Amendments

White Glove may update these T&C at any time. Continued use of our services constitutes acceptance of updated terms.

e. Entire Agreement

These T&C constitute the entire agreement between you and White Glove Appliance Service.

f. Force Majeure

White Glove is not liable for delays caused by events beyond our control, including natural disasters, supply chain disruptions, or government actions. Adapted from the original force majeure clause: “strikes, pandemic… fires, flood… acts of God…”
